Contruction Certificates

Assessment and approval of road and drainage design plans for subdivisions, and issue of Construction Certificate authorising commencement of works.

As many in the land development industry are aware, Council resources are often strained in times of a demanding market and the resulting delays are always costly.  Private Certifiers bring the ability to respond to market demands, and provide an alternative and timely solution to the issue of Construction Certificates.

Complying Development Certificates (Subdivision)

With Council’s adopted standards for Exempt and Complying Development, some subdivisions are able to be approved by Accredited Certifiers.  The extent of Complying Development largely depends on each individual Council, however State Environmental Planning Policy (SEPP 60), sets a minimum criteria state wide where the local Council has not adopted its own policy.

Of particular relevance, is the classifying of Strata Subdivision as Complying Development.

A number of local government areas allow strata subdivision to be given approval by Accredited Certifiers-Category B1, thus avoiding the time consuming delay in obtaining a separate development consent before proceeding to the signing of the strata plan.  (Issue of the Strata Certificate).

Since these local policies vary between Local Government Areas and over time, please contact our office for up-to-date advice on for strata subdivision and Complying Development Certificates.

Strata Certificates

Amendments were made to the Strata Schemes Acts in mid 2000 mirroring the changes in the Environmental Planning and Assessment Act, to allow strata plans to be signed by Accredited Certifiers.

Since that time the use of certifiers by the development industry is recognized as an efficient and timely means to obtain plan registration.

When linked to a Complying Development Certificate (where possible) costly delays in the issue of a Strata Certificate can be avoided.

Remember, the earliest possible issue of a Strata Certificate leads to early plan registration and early settlements.

Compliance Certificates

Compliance Certificates can be issued by Accredited Certifiers to acknowledge a condition (or conditions) of development consent has been satisfied.
In this regard, the consent condition may be one that stipulates design criteria (eg on-site stormwater detention or road design) or may relate to completion of constructed works.
Our services offered include both types of Compliance Certificates (design and construction), however opportunities for on-going inspections on subdivision works are currently limited due to staffing resources (subject to change).

Subdivision Certificates

As an Accredited Certifier (Category B1) under the Building Professionals Board Accreditation Scheme, we are able to be appointed as the Principal Certifying Authority (PCA) for land subdivisions (subject to local LEP limitations).

The PCA is the authority who is required to issue the final subdivision clearance by endorsing the plan of subdivision.  Once signed, the subdivision plan can be lodged with the NSW Dept of Lands for registration, and separate titles are created for new allotments.

As with Complying Development, our appointment as PCA is dependent on Council’s Local Environmental Plan accepting private Certifiers in that role.

Principal Certifying Authority (Subdivision)

The role of the PCA is that of coordinating full compliance with the conditions of Development Consent.  Opportunities at this stage are limited by Council Local Environmental Plans, but certain minimum inclusions have been established by State Environmental Planning Policy 60.

In the subdivision field, the major responsibility of the PCA is to issue the Subdivision Certificate.  This certificate authorises the registration of the subdivision plan which subsequently enables the issue of separate titles for each allotment created.
